Which Betfair Company Applies to You? Residence Rules and Broker Lists

Betfair's terms put Australia on their prohibited list and also give it a company of its own.

Your country of residence decides which Betfair company applies: TSE Malta LP for the United Kingdom, Betfair Pty Limited for Australia and New Zealand, and Betfair International Plc for residents of anywhere else, with proof of that residence asked at registration.

The terms also print a list of Prohibited Territories. Read it as a clause in a contract; it is no map of where Betfair is available, so this page gives no list of served countries and no commission rates (the exchange commission calculator works with the rates that publishers do state). Brokers that show Betfair prices are covered further down.

Which Betfair company is yours?

Betfair's General Terms are the one document this page leans on. The wording below comes from that archived copy. Terms change, so open the live page and confirm a clause before you rely on it.

The company, its regulator and the governing law all follow from residence (clauses 1.1 to 1.3), and each card below takes one company. What each exchange name means at the brokers is the job of the betting exchanges hub; this page stays with Betfair's own rules.

Betfair Pty Limited: residents of Australia and New Zealand

What the terms say

  • Says it is licensed and regulated by the Northern Territory Racing and Wagering Commission, with a betting exchange licence under the Racing and Wagering Act 2024 (NT). Under clause 25.2, Australian law governs.
  • A separate product with its own help centre. Those pages (read live) say identity must be verified before you can reach the Exchange, that data is stored on Australian servers, and that the ID they list is an Australian passport or licence.

Betfair International Plc: everyone else

What the terms say

  • Says it is licensed and regulated by the Malta Gaming Authority, licence MGA/CRP/131/2006. Under clause 25.3, Maltese law governs.
  • The catch-all for residents of anywhere other than the United Kingdom, Australia or New Zealand.

What the terms ask of you at registration

Clauses 4.1.3 and 5.1 turn residence into a declaration you must back up. Betfair's terms say you give:

  • your correct date of birth, with valid identification that proves it;
  • your country of residence, backed by the same identification;
  • your current address, which the registration form asks for as a full residential address;
  • a location, at registration and afterwards, outside every country on the prohibited list.

A failure to supply information Betfair asks for lets it restrict the account in any manner it reasonably deems appropriate (clause 5.6). Does a broker sit between you and these clauses, or beside them? That question is taken up after the charges.

How does Betfair know where you are?

Betfair's developer support says location checks rely on MaxMind GeoIP data, which it calls the source of truth for its location information. So the location of your connection is what is checked.

The list Betfair prints about itself

Clause 4.1.6 has you confirm that you are not located in a country where use of the services is prohibited, including Australia, Bulgaria, Canada, Cyprus, Denmark, France, Germany, Italy, New Zealand, Poland, Romania, Slovenia, Spain, Turkey and the United States, among others, and any other country with a comparable legal situation. This is the list printed in the terms, not a list of where Betfair is available, and it can change.

It is also a document with a visible seam. Australia and New Zealand appear in it while clause 1.2 gives them their own company, and the text never explains the overlap. A reader in a country from the list should stop at this point: the terms make location and residence the test, and nothing on a broker's page read here changes the wording of clause 4.2.

Location and breach, in the contract's words

Betfair's terms say it does not permit accounts to be opened by people located in a Prohibited Territory, or accessed or operated from one, deliberately or accidentally (clause 4.2). They treat as a Prohibited Activity an account used from a location that does not match the address on the account, one where the location or IP address has been disguised or interfered with, and one opened with incorrect or misleading information (clauses 11.2.3 and 11.2.7).

The stated consequences are voided transactions, withheld winnings and suspension or closure of the account (clause 11.1). This is what the contract says, and this page gives no way round it. Gambling is for adults only (18+) and legality varies by country. Pages that imitate Betfair's account pages are a common phishing route, so type the address yourself.

When the account freezes

Betfair's help page on suspended accounts (archived copy of 5 May 2026) lists the reasons. They include missing proof of identity or address, personal details that already exist on another account, and an attempt to reach the site from a country where gambling is prohibited. While the suspension lasts, funds cannot be accessed or withdrawn, yet bets that are already placed keep running. If the cause is not resolved, Betfair says it will restrict or permanently close the account, and its reopening page says it cannot reopen an account closed for commercial or business reasons.

The restricted countries page for Pinnacle shows the same kind of residence rule, read from three versions of its terms. Stake limits on winning customers are a different matter: no official Betfair text read describes them for the Exchange.

Charges: what residence decides, and who pays the Expert Fee

Betfair says the Market Base Rate, the maximum commission on some markets, is determined by your country of residence. Customers in the United Kingdom, Ireland, Finland, Hungary, Latvia, Croatia and Ukraine choose a rewards package instead, according to the charges page (archived 19 December 2025). The table of rates by country could not be read, so no rate is quoted here; rates differ by country and by entity.

The Expert Fee is better documented. Betfair replaced its Premium Charge with it; the last Premium Charge week ran from 30 December 2024 to 5 January 2025. Betfair says the fee is paid by a very small number of the most profitable customers, fewer than 0.5% of them, and is capped at 40%. It applies when gross profit over the last 52 active weeks tops 25,000 pounds and the customer has also bet in more than 100 Exchange markets, at 20% up to 100,000 pounds and 40% above that, and Betfair adds that it links accounts it believes belong to one person. The clause read is titled for other regions, not including Australia or New Zealand, so read your own entity's version. The Expert Fee is a minor worry for most readers, because the threshold is high and Betfair puts the affected share below one customer in two hundred.

Betfair exchange brokers: what each one lists

The four brokers follow in the usual order. BetInAsia, MadMarket and Sportmarket were read directly for this page; the AsianConnect wording comes from an earlier reading. Dates are given where a page shows one.

BetInAsia lists Betfair Exchange among the exchanges on its BLACK platform (help article updated 2026-09-26). Reviewers report that withdrawals wait on compliance checks which ask for documents more than once, so a listing tells you little about how quickly money comes out.

AsianConnect does not list Betfair Exchange on the pages read. Its home page writes Powered by Betfair on the exchange card and its OrbitX page is titled Betfair Access; neither names a Betfair account. Trustpilot reviewers (2.6 out of 5 from 16 reviews, a small sample) mostly describe withdrawals held under review for months.

MadMarket says its Edge platform shows Betfair Exchange prices and that no separate account is needed to see them. The wording covers prices only; an account with Betfair is not mentioned. MadMarket is a young operator, its licence date differs between its terms and the registry, and with no independent review to read, its statements are claims.

Sportmarket lists Betfair under Sportsbook / Exchange on the account it sells as Pro. The books behind that account may cancel bets under its terms, and proof of the source of funds can be requested at any time, even after an identity check passed, so a listed exchange still sits behind the broker's own checks.

Residence goes unmentioned on every broker page read. Betfair's terms require an account opened solely for your own personal use (clause 4.1.4) and count suspected business usage as a breach, defined to include use by a betting operator or by anyone supplying data or services to one (clauses 11.2.5 and 11.2.13). The terms and the broker pages leave open whether any of that reaches a broker's customers.

Frequently asked questions

Why does Betfair say my country is not allowed?

Betfair's terms tie the service to your country of residence and to where you are located when you use the account, and clause 4.1.6 prints a list of Prohibited Territories. The list section above explains how to read it; the live terms on Betfair's own site are the text to check.

Is Betfair Australia the same as Betfair.com?

The terms name a separate company, Betfair Pty Limited, for residents of Australia and New Zealand, and Betfair's Australian help centre describes its own product with its own identity checks. Treat the two as different services with different terms. Rates and fees are not published here.

Can a broker give me a Betfair account?

BetInAsia and Sportmarket list Betfair, and MadMarket says its Edge platform shows Betfair prices without a separate account, which is a statement about prices. The broker pages are silent on whether a broker customer becomes a Betfair account holder and on how Betfair's residence clauses apply to one, so draw no such conclusion.

What happens to my balance if Betfair suspends the account?

Betfair's help page says funds cannot be accessed or withdrawn while the suspension lasts and that placed bets keep running. Missing proof of identity or address is the first reason it lists, so the paperwork is the part you control; the frozen account section above has the rest.

Is the Expert Fee the old Premium Charge?

It replaces it, and Betfair says the old 50% and 60% rates are gone. The conditions are in the charges section above.
